Deb & Russ Can Help You Find It

Why Use a Buyer's Agent? Your Representation Matters

Every property you see listed for sale already has an agent—the seller's agent, whose job is to get the highest price and best terms for the seller. When you contact that listing agent directly, you're talking to someone whose loyalty, by law and by contract, belongs to the seller. The only way a listing agent can also represent you as a buyer in South Carolina is through dual agency—an arrangement where the agent cannot fully advocate for either party. That's not representation. That's compromise. You deserve someone whose sole focus is protecting your interests, negotiating on your behalf, and ensuring you make informed decisions throughout what's likely the largest financial transaction of your life.

The Dual Agency Problem in South Carolina

Under South Carolina law (SC Code § 40-57-350), a listing agent can only represent both the buyer and seller through disclosed dual agency. In dual agency:

• The agent cannot advocate for one client over the other
• The agent cannot disclose your willingness to pay more than your offer
• The agent cannot disclose the seller's willingness to accept less than asking price
• The agent cannot share confidential negotiating strategies
• Representation becomes limited—both parties lose full advocacy

South Carolina law explicitly states that "agency duties are limited" in dual agency situations. You're essentially negotiating without a true advocate on your side.

What a Dedicated Buyer's Agent Provides

When you work with Southern Coast Realty as your buyer's agent, you gain exclusive representation focused entirely on your goals. We're not trying to balance competing interests. We're not neutralizing our effectiveness to serve both sides. We're working for you—period.

Your Buyer's Agent's Fiduciary Duties to You

  • Loyalty: We advocate exclusively for your interests in every decision and negotiation
  • Confidentiality: Your budget, motivation, and strategy remain confidential—never disclosed to sellers
  • Disclosure: We share all material facts about properties that could affect your decision
  • Reasonable Care: We exercise professional skill and diligence in serving your needs
  • Obedience: We follow your lawful instructions and priorities throughout the process
  • Accounting: We handle all financial aspects with transparency and accuracy

These aren't just nice-to-have services. They're legal obligations we owe exclusively to you when you establish a buyer agency relationship with us through a written agreement. Under dual agency, these same duties become limited or impossible to fulfill because the agent owes them equally to both buyer and seller—two parties with naturally opposing interests.

The Real-World Impact: What You Gain (Or Lose)

The difference between having your own agent and accepting dual agency isn't theoretical. It affects actual outcomes:

Negotiating Power: Your buyer's agent can aggressively negotiate price, repairs, closing costs, and timelines without worrying about offending the seller. A dual agent must remain neutral, limiting their ability to push hard for the concessions you deserve.

Market Intelligence: We share comparable sales data that might show a property is overpriced, help you understand neighborhood value trends, and identify properties with better value propositions. A dual agent cannot advise you that "this house is overpriced" because they also represent the seller who set that price.

Inspection Advocacy: When the inspection reveals issues, your buyer's agent fights for repairs, credits, or price reductions. A dual agent cannot advocate strongly for repairs because they're also trying to protect the seller's net proceeds.

Confidential Strategy: We can discuss your absolute maximum price, deadline pressures, or contingency flexibility privately, then use that information strategically. A dual agent cannot keep these details confidential from the seller.

Objective Guidance: Your agent can tell you when to walk away from a bad deal, when a property has hidden value others miss, or when you're about to overpay. A dual agent's advice becomes guarded and limited to avoid favoring one party.

How Russ & Deb Serve You as Exclusive Buyer's Agents

As Certified Buyer Agents (CBA designation from the National Association of Realtors), we've completed specialized training in buyer representation, negotiation strategy, and fiduciary responsibility. Our focus is protecting your interests, not facilitating deals that compromise your position.

Russ's contractor background gives you a unique advantage. As a former licensed General Contractor, Russ recognizes quality construction methods, superior building standards, and properties built to last. During property tours and inspections, he evaluates structural integrity, identifies quality materials and craftsmanship, and helps you understand what separates well-built properties from those with shortcuts. This expertise helps you recognize exceptional value and make confident decisions based on actual property quality—not just aesthetics and location.

We provide access to actual rental income data. For investment properties or second homes you plan to rent, we connect you with property managers who share historical performance data—not projections. You see exactly what comparable properties grossed during past seasons, how occupancy patterns played out, what nightly rates guests actually paid, and what operating expenses reduced net income. This transparency replaces speculation with facts that inform your investment decisions.

We guide you through the complete process:

  • Clarifying your goals, priorities, and budget to focus your search efficiently
  • Identifying properties that match your criteria, including off-market opportunities
  • Evaluating neighborhoods, market trends, and property values objectively
  • Touring properties and providing honest assessments of condition and value
  • Crafting competitive offers with strategic terms and contingencies
  • Negotiating aggressively for the lowest price and best terms
  • Managing inspections, appraisals, and due diligence timelines
  • Advocating for repairs, credits, or price adjustments based on findings
  • Coordinating with lenders, attorneys, and other professionals
  • Protecting your interests through closing and beyond

Common Questions About Buyer Representation

Does using a buyer's agent cost me anything?
Typically no. Buyer's agent compensation is usually negotiated as part of the transaction and can be paid by the seller, included in the purchase price, or structured as a seller concession. We discuss compensation terms upfront so you understand exactly how we're paid. Our value—better negotiation, avoided mistakes, and informed decisions—typically far exceeds any cost consideration.

What if I find a property I love that's listed by another agent?
Perfect—that's exactly when you need your own representation. We work with the listing agent to negotiate on your behalf while protecting your confidential information and advocating exclusively for your interests. This is standard practice in real estate transactions.

Can I still attend open houses and browse properties online?
Absolutely. Once we establish our buyer agency relationship, you can explore properties however you like. When you find something interesting, we handle the next steps—requesting disclosures, scheduling private showings, researching comparable sales, and preparing your offer strategy.

What if the listing agent offers dual agency?
You have every right to decline dual agency and maintain your exclusive buyer representation with us. In fact, we recommend it. Dual agency benefits the agent (they keep the entire commission) more than it benefits either party to the transaction. You're under no obligation to accept limited representation just because it's convenient for the listing agent.

Do you work with first-time buyers?
We love working with first-time buyers. The process can feel overwhelming when it's new, and having someone explain each step, answer your questions without judgment, and protect you from costly mistakes makes the experience significantly better. Many of our clients were first-time buyers who appreciated our patient guidance through their first purchase.
